General terms and conditions of sale

By registering for travel services, you acknowledge that you have read the general terms and conditions of sale and the description of the chosen holiday.

On our website and for each of our tours, we provide you with a data sheet containing information about the tour, including the nature and specifics of the trip, the program and all other useful information.

The owner of a file must be of legal age.

1. REGISTRATION

1.1. How to register

Registrations can be made by telephone or via the website : desertravel-voyalgerie.com by going to the “Contact” section to access the reservation form. An estimate will be sent to you by e-mail. Once the quote has been accepted, you will need to complete the registration form, fill in any special requests or requirements and pay a deposit of 30% of the tour price and 100% of the airfare (flights within Algeria).

Registration is confirmed on receipt of payment by bank transfer.

This will be sent to you by e-mail, together with your booking number and confirmation invoice.

Registration must be made in the first and last names of each traveler as they appear on the identity documents used for the trip. It is the responsibility of each traveler to verify the spelling of first and last names on travel documents (tickets, visas, etc.) must match those on identity papers.

For groups, each participant must complete an individual registration form.

For works councils and associations, the person in charge must also complete an information form on behalf of the organization he/she represents.

The person making the booking confirms that all persons indicated on the booking request and on the invoice have agreed to be bound by all applicable contractual conditions and that he/she has the authority to accept these conditions in the name and on behalf of all persons mentioned on the booking request and on the invoice.

1.2. No right of withdrawal

In accordance with article L. 221-28 of the French Consumer Code, once your registration has been validated, you have no right of withdrawal in respect of the purchase of travel services offered for sale under these conditions of sale.

2. TERMS OF PAYMENT

2.1 Terms of paymentAll prices are quoted in Algerian dinar or foreign currency (after conversion), taxes included.

For bookings made more than 45 days before departure, a deposit of 30% of the tour price and 100% of the airfare

(flights within Algeria) will be requested. The balance must be paid no later than the first day of arrival in Algeria.

If you register less than 45 days before the departure date, you must pay the full price of the trip, which corresponds to the 50% deposit plus the balance.

A registration fee of 5,000 dinars (approx. €20) per person will be charged at the time of payment of the 50% deposit or at the time of payment of the total price of the trip.

Any delay in payment may be considered as a cancellation, for which a fee will be charged.

2.2 Payment methods

Payments are made by bank transfer.

3.MODIFICATIONS AND CANCELLATIONS AT THE CUSTOMER'S REQUEST

3.1 Modifications

If you are unable to travel on the planned dates for medical reasons, you will be asked to provide proof of the alleged illness and its incompatibility with the planned trip. Our agency will make a decision in this regard and may, if possible, offer you alternative dates or a credit note valid for 12 months.

All other reasons listed below do not give rise to any possibility of modification or cancellation

-Loss or theft of passenger tickets.

-Failure to present identity and/or health documents (expired, insufficiently valid or not in compliance with prescribed formalities) required to undertake the trip and/or cross borders.

Arrival after the scheduled check-in and/or boarding time.

3.2 Refund conditions and costs

In the event that you are obliged to cancel your trip, you must inform us in writing by any means capable of producing an acknowledgement of receipt.

The 30% deposit and 100% of the airfare are non-refundable.

Once the balance has been paid, refund charges apply according to the schedule below:

- more than 45 days before departure: 100% of the tour price, excluding deposit

- between 45 and 31 days before departure: 50% of the tour price excluding deposit

- between 30 and 16 days before departure: 25% of the tour price, excluding deposit

- less than 16 days before departure: no refund possible

3.3 Trip interruption

If you interrupt your trip, you will not be entitled to any refund.

3.4 Assignment of contract

In accordance with article R.211-7 of the French Tourism Code, the traveler may assign his or her contract to a transferee who meets the same conditions as the traveler, in order to take the trip in his or her place, as long as this contract has not produced any effect. You are required to inform the agency of your decision by any means capable of producing an acknowledgement of receipt, and no later than fifteen days before the start of the trip. The assignor and the assignee are jointly and severally liable for payment of the balance of the price as well as any expenses incurred (registration fees for the assignee).

3.5 Group and customized tours :

When several travelers are registered on the same booking form, payment of the deposit or the entire trip must be made by a single person. A deposit of 30% of the total tour price is required for group bookings of 6 people or more, or for customized tours.

A registration fee of 5,000 dinars (approx. €20) per person will be charged upon payment of the 30% deposit or upon payment of the full tour price.

The 30% deposit is non-refundable under any circumstances.

If one or more travellers on the same registration form cancel their participation, they run the risk of jeopardizing the continuation or otherwise of the group trip.

If the course is maintained and the balance has been paid, reimbursement costs are calculated on the share of the participant who cancels his trip, according to the scale below:

- more than 45 days before departure: 100% of the participant's share, excluding deposit

- between 45 and 31 days before departure: 50% of the participant's share, excluding deposit

- between 30 and 16 days before departure: 25% of the participant's share excluding deposit

- less than 16 days before departure: no refund possible

4.MODIFICATIONS AND CANCELLATION BY THE AGENCY :

4.1 Trip modifications

Minor modifications to the program may occur due to organizational difficulties. In this case, we will inform you promptly in a clear, comprehensible and visible manner on a durable medium.

4.2 Cancellation

Force majeure (war, political unrest, riots, natural disasters, etc.) may result in cancellation of the trip. In this case, we will inform you promptly. You will have the choice between a refund or rescheduling to another date. However, you will not be entitled to any compensation from the agency. In addition, any external costs incurred by the traveller, such as transport costs, visa fees or any other travel documents, will not be reimbursed.

4.3 Price adjustment

In accordance with article L211-12 of the French Tourism Code, the price may be adjusted upwards or downwards, up to 20 days before the departure date, without you being able to cancel, for one or other (or both) of the following price changes:

-passenger transportation resulting from the cost of fuel or other energy sources

-the level of taxes or fees on travel services (tourist taxes, landing taxes or embarkation and disembarkation taxes at ports and airports).

Any refusal on the part of the traveler(s) to pay this revision, insofar as it is not significant, will be considered as a cancellation on the part of the traveler and cancellation fees will be applied.

5.TRAVEL INFORMATION

5.1 Administrative and health formalities

Before registering, we ask you to ensure that you are in compliance with all police, customs and health formalities (valid passport, required visa, exit permit(s) for minors, family record book, etc.). This information is provided in the “Travel Guide” section. All costs relating to formalities are your responsibility. No refund will be made if the traveler is unable to depart due to non-compliance with these formalities.

5.2 Safety and health risks

All travelers must read and follow the health and safety instructions issued by the Ministry of Europe and Foreign Affairs. This information may change up to the date of departure. We strongly advise you to consult them regularly. Travelers certify that they are aware of the health and safety risks associated with the trip, and release the agency and its partners from all liability for any problems that may arise during or after the trip. The agency undertakes to do everything in its power to ensure the safety and smooth running of the trip.

5.3 Minors

Minors must be registered on the same booking as an authorized accompanying adult. Entries for minors must be signed by both parents and/or guardian, with the words “father's agreement, mother's agreement...”.

Customs authorities may require a document proving that the accompanying person is indeed the parent or legal guardian (family record book). The minor remains under the responsibility of the person with parental authority. All minors must be accompanied by an adulte.

5.4 Accessibility

Our trips require varying degrees of physical involvement and are not accessible to all. Please contact us for further information.

6.MEDIATION OF TRAVEL SERVICES

For flight, hotel and insurance services offered on an optional basis by the agency (collectively referred to as “travel services”), we act exclusively in our capacity as intermediary. For these purposes, our role and obligations are limited to the mediation of travel services that will be rendered by third parties such as airlines, tour operators, hotels, insurers, or other service providers.

Consequently, the agreement for the actual provision of travel services (e.g. contract of carriage, insurance contract) comes into effect directly between you and the relevant service provider. We are not a co-seller of travel services and we are not a party to the contractual relationship between you and the service provider.

7.INSURANCE

In order to take part in our tours, you must be insured (repatriation, hospitalization and medical expenses) abroad. We invite you to check whether you are also covered by these policies.

You must take out insurance before or during your stay by contacting the insurance company covering your trip.

8. LIABILITY

8.1 Responsibility of the agency

The agency cannot be held responsible for the consequences of the following events:

-Incidents or unforeseeable and insurmountable events of a foreign third party such as: wars, political unrest, strikes outside the agency, foreign riots, airspace congestion, bad weather, delays (including in mail forwarding services...), breakdowns, loss or theft of luggage or other personal effects of travelers.

-Cancellation due to exceptional and unavoidable circumstances.

9.CLAIMS

Travelers may submit any claims by e-mail, accompanied by all supporting documents, within 8 days of the customer's return date. After this period, no claim will be accepted.

10.PERSONAL INFORMATION

The information you send us is recorded in a computerized file by the agency. Certain information must be provided when you request a quote or register. The agency undertakes not to transfer or sell your personal data to third parties other than our partners. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, you have the right to access and rectify any personal data concerning you that is processed. 11.MODIFICATION OF SALES CONDITIONS

The agency reserves the right to update and modify the conditions of sale at any time without prior notice. The conditions of sale applicable to tour bookings are those in force on the day of booking.
